Voting Period

Voting Restrictions

Voting is only open to Australian and New Zealand residents who are aged 18 years and over. 

Voting Method

To vote during the Campaign, the voter must, during the Voting Period: visit moccona.com.au/makeadifference between 15th July and 18th September 2022 and submit a vote form or visit moccona.co.nz/makeadifference between 1st August and 18th September 2022 and submit a vote form.

Voting Determination

This campaign includes an AUD100,000 cash donation to be among six (each a “Cause”): Dismantle, Bees Up Top, ORRCA, Wildlife Victoria, KiwiHarvest and Planet Ark. Each Cause will receive a base of AUD5,000 plus a share of the remaining AUD70,000 in accordance with the percentage of votes received during the Voting Period. No purchase is necessary.  The donation amounts will be calculated and announced by 30th September 2022 and paid out by 31 December 2022.  Donation amount to each Cause is based on the percentage of votes received through the entire Voting Period across Australia and New Zealand (for example, a Cause getting 10% of all votes will receive a AUD7,000 donation plus the AUD5,000 base donation).  Interim indications may be announced within the campaign for consumer information, however final donation will be based on the above calculation.

Instagram and Facebook

The Campaign Provider may communicate or advertise this campaign using Facebook or Instagram. However, each voter releases Facebook and Instagram from all liability in relation to the Campaign and acknowledges that this Campaign is in no way sponsored, endorsed or administered by, or associated with Facebook and Instagram and that any information provided by voters is provided to the Campaign Provider and not to Facebook or Instagram.

Standard Terms and Conditions

  1. The voter agrees and acknowledges that they have read these Conditions of Voting  (including the Schedule) and that voting is deemed to be acceptance of these Conditions of Voting (including the Schedule). Any capitalised terms used in these Conditions of Voting have the meaning given in the Conditions of Voting and Schedule, unless stated otherwise.
  2. The Campaign commences on the respective Start Dates and ends on the End Date ("Voting Period"). Votes are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the voter. Records of the Campaign Provider and its agencies are final and conclusive as to the time of receipt.
  3. Valid and eligible votes will be accepted during the Voting Period.
  4. Employees (and their immediate family members) of agencies/companies directly associated with the conduct of this Campaign, the Campaign Provider, businesses involved in determination of winner/s for the Campaign, businesses involved in the management of the Campaign, any organisation benefiting from the Campaign, the Campaign Provider’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. Voters' personal information will be collected by the Campaign Provider. Personal information will be stored on the Campaign Provider’s database. The Campaign Provider may use this information for future marketing purposes regarding its products, including contacting the voter electronically where consent by the voter has been obtained. The Campaign Provider’s Privacy Policy contains information about how the voter may access, update and seek correction of the personal information the Campaign Provider holds about them and how the voter may complain about any potential breach by the Campaign Provider of any privacy laws and how such complaints will be dealt with.  The Campaign Provider collects personal information about voters to enable them to participate in this Campaign and may disclose the voters' personal information to third parties including its contractors and agents and service providers to assist in conducting this Campaign. If the voter does not provide their personal information as requested, they may be ineligible to vote in the Campaign. The Campaign Provider may transfer voters' personal information to countries specified in the Promoter’s privacy policy.
  6. To the extent permitted by law, if for any reason any aspect of this Campaign is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Campaign Provider, the Campaign Provider may in its sole discretion cancel, terminate, modify or suspend the Campaign and invalidate any affected votes, or suspend or modify a prize.
  7. The Campaign Provider reserves the right, at any time, to validate and check the authenticity of votes and voter’s details (including a voter’s identity, age and place of residence). The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render any votes submitted by that individual invalid.
  8. The Campaign Provider reserves the right to disqualify votes in the event of non-compliance with these Conditions of Voting. In the event that there is a dispute concerning the conduct of the Campaign, the Campaign Provider will resolve the dispute in direct consultation with the voter. If the dispute cannot be resolved the Campaign Provider’s decision will be final.
  9. The Campaign Provider and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Campaign, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  10. Failure by the Campaign Provider to enforce any of its rights at any stage does not constitute a waiver of these rights.
